An Adversary Removal removes an existing case from a State or District Court to the Southern District of California Bankruptcy Court.

Using the Open an AP/MP Case option allows you to enter case data screen-by-screen. Once the adversary removal case is opened, the system will automatically assign an adversary case number.

Below are screen instructions on how to open and attach the Notice of Removal and Adversary Cover Sheet (B1040) (PDF file). Use the Cover Sheet as your guide to enter ECF data.  Check the hyperlinks for more helpful information

  1. Select Adversary.

  2. Select Open an AP/MP Case.

    • Select "n" in the Complaint field.

    • Select plaintiff or defendant in "Counsel for" field.

  3. Add associated case.

    • Enter related California Southern (CASB) bankruptcy case. Do not add judges initials nor chapter number.

      • If the bankruptcy case is closed, the following message will appear and you will not be allowed to open the Adversary Removal case. "WARNING! 00-000 is closed.  Refer to Local Rule 5010 on reopening case."

    • IF NOT a CASB (California Southern Bankruptcy) case number, DO NOT ADD Related Case Number.

      • Click "OK" on Warning: related case not entered.

  4. Submit.

  5. Are you lead attorney?  Select yes or no.

  6. Search for Plaintiff screen.

    • Enter social security number, tax identification number, last name or business name.

      • From the Party Search Results screen

        • Plaintiff name appears.

        • Plaintiff names does not appear

      • Verify Plaintiff information and submit.

      • Repeat these steps to add additional plaintiff(s) or

        • Select End plaintiff selection.

  7. Search for Defendant screen.

    • Enter social security number, tax identification number, last name or business name.

      • From the Party Search Results screen

        • Defendant name appears.

        • Defendant name does not appear.

      • Verify Defendant information and submit.

      • Repeat these steps to add additional defendant(s) or

        • Select End defendant selection.

  8. Select  the appropriate Statistical Information.

    • Party Code - select appropriate code from drop-down list.

    • Rule 23 (class action) - select "yes" if filing indicates a class action.

    • Jury Demand - select "plaintiff" if filing indicates a jury demand.

    • Demand ($000) - enter amount for demand (ie, 5 = 5000).

    • State Law - y, n or unknown.

    • Primary Nature of Suit - select from drop-down list.

      • Second, Third, Fourth, Fifth Nature of Suit - select from drop-down lists, if applicable.

  9. Select event: Removal of Case (Notice)(fee).

  10. Browse, verify and attach the document (PDF file).

    • Attach supportive documents, if applicable.

  11. Enter name of court case is removed from.

    • Enter their case number (civil case number).

    • Verify filing fee.

  12. Modify text, if applicable.

  13. Verify final docket text before submission.

  14. Print the Notice of Electronic Filing. It's your receipt.

    • Make note of the adversary case number.
