IMPORTANT:  Use the Petition as your guide to enter ECF data.  Check the hyperlinks for more helpful information. Only the 401, Chapter 15 petition form, is required (minus schedules and statements).  The CSD 1801 (Declaration Re: Electronic Filing is not required). When filing a Chapter 15 for Recognition of a Foreign Nonmain Proceeding, the 401 and the Summons (CSD2500F) are required.

 

  1. Select Bankruptcy menu.
  2. Select Open a BK Case.
  3. Select the appropriate information for the following fields:
    • Chapter - 15
    • Main/Nonmain - select one:
      • Chapter 15 for Recognition of a Foreign Main Proceeding
      • Chapter 15 for Recognition of a Foreign Nonmain Proceeding
        • Summons (CSD2500F) is required for a Foreign Nonmain Proceeding.
    • Joint Petition - accept no.
    • Deficiencies - accept no.
  4. Search for a Debtor Screen.  
    • Enter tax identification number, last name or business name to search for debtor name in the CM/ECF database. 
    • Party search results. Click on the hyperlink for data input. 
      • Debtor Name does not appear..
      • Debtor name appears
      • Debtor name appears but mailing address is incorrect..
    • Verify once more for correct party information and Submit.  
  5. Select the appropriate Statistical Information:
    • Fee Status: Paid
      • Type of Debtor - Corporation, Partnership or Other.
  6. Browse, verify and attach the Petition (PDF file).
    • For a Foreign Main Proceeding, attach the 401 .
    • For a Foreign Nonmain Proceeding, attach the 401 and the Summons (CSD2500F) 
  7. Verify filing fee. 
  8. Verify final docket text before submitting onto case docket.
  9. Print the Notice of Electronic Filing. It's your receipt.
  10. Make note of the assigned case number. 
  11. Continue procedure with assigning Judge to the bankruptcy case.
  12. File the following required documents:

Case opening is a term that the bankruptcy court uses to combine several process to complete a petition filing.

For a Chapter 15 Recognition of Foreign Proceeding case opening process, complete the following procedures and file its appropriate supportive documents:

  1. Open Voluntary BK Case.
  2. Assign Judge/Trustee
  3. File Required Documents (see Step 12)
